The legally binding agreement governing your access to and use of the Binko application. Please read carefully before registering.
Age Requirement
You must be at least 18 (eighteen) years of age to register and use Binko. By accepting these Terms you represent and warrant that you are 18 years of age or older. Accounts found to belong to persons under 18 will be permanently banned without notice.
Legal Capacity
You represent and warrant that you have the legal capacity to enter into a binding agreement under applicable Indian law and that your use of the App does not violate any law, order, or regulation applicable to you.
One Account Per Person
Each User is permitted one account linked to one verified mobile number. Creating multiple accounts is prohibited and will result in termination of all associated accounts.
Referral Requirement
Access to Binko is by invitation only. You must hold a valid, unused referral link issued by an existing User in good standing. Referral links are personal, non-transferable, and may not be sold, advertised, or distributed publicly.
Geographic Availability
The Service is currently available only to Users who are physically present at Partner Venues in India. The Company makes no representation that the Service is available, appropriate, or lawful in any other jurisdiction.
Meeting Accelerator, Not a Dating App
Binko is a real-world social discovery tool designed to facilitate introductions between Users who are physically co-located at the same Partner Venue. It is not a dating application, a messaging platform, a social network, or a venue booking service.
Not a Safety Service
Binko is not an emergency response service, a security provider, or a safeguarding authority. The App does not monitor physical spaces, supervise interactions, or guarantee User safety. Users must rely on their own judgment, venue staff, and, where necessary, emergency services.
Not a Party to User Interactions
Any interaction, conversation, or meeting between Users — whether in-app or in person — is solely between those Users. The Company is not a party to any such interaction and accepts no responsibility for its nature, outcome, or consequences.
Not a Party to Venue Transactions
The Company is not a party to any commercial arrangement between a User and a Partner Venue. Offers displayed in the App are provided by venues acting entirely independently.
Accurate Information
You agree to provide accurate, current, and complete information at registration and to keep it accurate throughout your use of the App. Your alias, date of birth, hair type, facial hair type, and glasses status must truthfully represent you.
Account Security
You are solely responsible for maintaining the confidentiality of your OTP and session token. The Company will not be liable for any loss or damage arising from your failure to protect your account credentials or from unauthorised access to your account.
Account Suspension and Ban
The Company may suspend or permanently ban an account for any breach of these Terms, including harassment, impersonation, creation of multiple accounts, circumvention of bans, or behaviour deemed harmful to other Users or to the integrity of the Platform.
Account Deletion
You may request deletion of your account at any time. Deletion requests initiate a 90-day soft-delete period, during which your account is deactivated but your data is retained. At the end of this period, your data is permanently deleted, subject to the Company's data retention obligations under applicable law.
You agree to use the App lawfully, respectfully, and in a manner consistent with the spirit of real-world social interaction. The following are strictly prohibited:
Zero Tolerance — Female Safety
The Company operates a female-first safety model. Any behaviour that makes a female User feel unsafe, threatened, or harassed will result in immediate account termination without warning and will be reported to law enforcement where the Company deems it appropriate.
Your personal safety is your own responsibility. By using the App, you acknowledge and accept the inherent risks associated with meeting strangers in person in a social environment.
No Background Verification
The Company does not conduct background checks, criminal record checks, identity verification, or any other vetting of Users. You must not assume that another User has been vetted or verified.
Venue Staff as First Responders
If you feel unsafe at a venue, you should immediately alert venue staff. In a genuine emergency, dial 112 (Indian national emergency number). The Company is not able to contact emergency services on your behalf.
All Offers displayed in the App are provided at the sole discretion of the Partner Venue. The Company does not create, fund, guarantee, underwrite, or control any Offer.
Alcohol Offers
Offers relating to alcoholic beverages are available only to Users who meet the legal drinking age applicable in their state or union territory at the time of redemption.
No Cash Equivalence
Offers have no cash value and may not be transferred, combined, or exchanged for cash. Attempting to redeem an Offer fraudulently is a material breach of these Terms.
To the fullest extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity; personal injury or bodily harm suffered at a venue or in connection with a User interaction; or the conduct, acts, or omissions of any other User, whether in-app or in person.
Aggregate Liability Cap
The core Service is provided free of charge to Users. To the extent any liability of the Company cannot be excluded by law, the Company's total aggregate liability to you for all claims shall not exceed INR 1,000 (Indian Rupees One Thousand Only).
Governing Law
These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, disputes shall be subject to the exclusive jurisdiction of the courts of Dewas, Madhya Pradesh, India.
Internal Grievance — Mandatory First Step
Before initiating any legal proceedings, you are required to submit a written grievance to the Grievance Officer at grievance@binko.app and allow 30 (thirty) days for the Company to respond and attempt resolution.
Arbitration
Any dispute not resolved through the internal grievance mechanism shall, at the Company's election, be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat shall be Dewas, Madhya Pradesh. The arbitral award shall be final and binding.
By registering for or using Binko, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions.
